1. Who we are and what these terms cover
ProfAI (the «App») is provided by Roberto Díaz Badra, a self-employed developer based in Spain trading as «Disruptive Normality» («we»). Contact: info@themachinelearners.com. By downloading or using the App you accept these Terms and our Privacy Policy. If you download the App from the App Store, Apple's standard Licensed Application End User License Agreement also applies; where these Terms are more specific, they complement it.
2. Who can use ProfAI
You must be at least 13 years old.
If you are under 18, or under the age of digital consent in your country, you need the permission of a parent or guardian, who accepts these Terms on your behalf and is responsible for any purchase.
3. What the App does
ProfAI helps you study: you take or choose a photo of an exercise, or write a question, and the App returns a step-by-step explanation generated by artificial intelligence, and lets you ask follow-up questions to an AI tutor. Some features are free with limits and others require a subscription.
4. AI answers: please read
Answers are generated automatically by AI (provided through OpenAI) and can contain errors. Check them, especially before an exam or graded work.
ProfAI is a learning aid. Use it to understand how to solve problems, and follow the rules of your school or teacher on homework and exams. You are responsible for how you use the answers.
The App is not a substitute for a teacher or for professional advice of any kind.
5. Reporting content
If an answer is wrong, offensive, unsafe or otherwise inappropriate, use the «Report» button on that answer. A person reviews reports, and we may adjust or block content and improve our safeguards as a result. You can also write to info@themachinelearners.com.
6. Acceptable use
You agree not to:
send content that is illegal, sexual, violent, hateful, harassing or that infringes the rights of others, or photos of other people without their permission;
try to make the AI produce harmful content or bypass its safeguards;
use the App to cheat in exams or evaluations where this is not allowed;
copy, resell, reverse-engineer or automate access to the App or its servers, or interfere with its operation.
We may limit or suspend use of the App in case of abuse.
7. Subscriptions and free trials
ProfAI Pro is offered as auto-renewing subscriptions (for example weekly, monthly or yearly, depending on your store and country). The price and period are shown in the App before you buy.
Payment is charged to your Apple ID or Google Play account when you confirm the purchase, or at the end of the free trial if one is offered.
The subscription renews automatically for the same period and price unless you cancel at least 24 hours before the end of the current period. Your account is charged for the renewal within the 24 hours before the period ends.
Free trial: if offered, the trial length and the price that applies afterwards are shown before you start it. If you do not cancel at least 24 hours before the trial ends, it converts into a paid subscription. Any unused part of a trial is lost when you buy a subscription.
Manage or cancel in your account settings: on iPhone, Settings → your name → Subscriptions; on Android, Google Play → Profile → Payments & subscriptions → Subscriptions. Uninstalling the App does not cancel a subscription.
Refunds are handled by Apple or Google under their policies. This does not affect any rights you have under applicable consumer law.
If we ever change the price of an existing subscription, the store will inform you in advance as required by its rules.
8. Your content
You keep the rights to the photos and texts you send. You give us a limited, non-exclusive licence to process them only to provide the App (including sending them to our AI provider), to review reports and to improve the App, as described in the Privacy Policy. Do not send content you do not have the right to use.
9. Our intellectual property
The App, its design, texts, logo and software belong to us or our licensors. We grant you a personal, non-transferable and revocable licence to use the App on your devices for non-commercial purposes, in line with these Terms and the store's rules.
10. Availability and changes
We work to keep the App available and accurate, but we do not guarantee that it will be uninterrupted or error-free. We may update, change or discontinue features. If we discontinue a paid feature in a significant way, you can cancel your subscription in your store account.
11. Liability
The App is provided «as is». To the extent permitted by law, we are not liable for indirect damages or for decisions made on the basis of AI answers, and our total liability is limited to the amount you paid for the App in the 12 months before the claim. Nothing in these Terms limits liability that cannot be limited by law, or your statutory rights as a consumer.
12. Changes to these Terms
We may update these Terms. We will change the date above and, for important changes, let you know in the App. If you keep using the App after the change, you accept the new Terms.
13. Law and disputes
These Terms are governed by Spanish law. If you are a consumer, you also keep the protection of the mandatory rules of your country of residence and can bring a claim before the courts of your place of residence.

1. Quiénes somos y qué cubren estos términos
ProfAI (la «App») la ofrece Roberto Díaz Badra, desarrollador autónomo con domicilio en España que opera como «Disruptive Normality» («nosotros»). Contacto: info@themachinelearners.com. Al descargar o usar la App aceptas estos Términos y nuestra Política de privacidad. Si descargas la App desde el App Store, también se aplica el Contrato de Licencia de Usuario Final estándar de Apple; estos Términos lo complementan donde son más específicos.
2. Quién puede usar ProfAI
Debes tener al menos 13 años.
Si tienes menos de 18 años, o no alcanzas la edad de consentimiento digital de tu país, necesitas el permiso de tu madre, padre o tutor, que acepta estos Términos en tu nombre y es responsable de cualquier compra.
3. Qué hace la App
ProfAI te ayuda a estudiar: haces o eliges una foto de un ejercicio, o escribes una pregunta, y la App te devuelve una explicación paso a paso generada por inteligencia artificial, y te deja hacer más preguntas a un tutor de IA. Algunas funciones son gratuitas con límites y otras requieren suscripción.
4. Respuestas de la IA: léelo
Las respuestas las genera automáticamente una IA (a través de OpenAI) y pueden contener errores. Revísalas, sobre todo antes de un examen o un trabajo evaluable.
ProfAI es una ayuda para aprender. Úsala para entender cómo se resuelven los problemas y sigue las normas de tu centro o de tu profesor sobre deberes y exámenes. Tú eres responsable de cómo usas las respuestas.
La App no sustituye a un profesor ni a ningún tipo de asesoramiento profesional.
5. Denunciar contenido
Si una respuesta es incorrecta, ofensiva, peligrosa o inapropiada por cualquier otro motivo, usa el botón «Denunciar» de esa respuesta. Una persona revisa las denuncias y, como resultado, podemos ajustar o bloquear contenido y mejorar nuestras salvaguardas. También puedes escribir a info@themachinelearners.com.
6. Uso aceptable
Te comprometes a no:
enviar contenido ilegal, sexual, violento, de odio, de acoso o que vulnere derechos de terceros, ni fotos de otras personas sin su permiso;
intentar que la IA genere contenido dañino o saltarte sus salvaguardas;
usar la App para copiar en exámenes o evaluaciones donde no esté permitido;
copiar, revender, hacer ingeniería inversa o automatizar el acceso a la App o a sus servidores, ni interferir en su funcionamiento.
Podemos limitar o suspender el uso de la App en caso de abuso.
7. Suscripciones y pruebas gratuitas
ProfAI Pro se ofrece como suscripciones de renovación automática (por ejemplo semanal, mensual o anual, según tu tienda y país). El precio y el periodo se muestran en la App antes de comprar.
El pago se carga a tu cuenta de Apple ID o de Google Play al confirmar la compra o, si hay prueba gratuita, al terminar la prueba.
La suscripción se renueva automáticamente por el mismo periodo y precio salvo que la canceles al menos 24 horas antes de que acabe el periodo en curso. La renovación se cobra en las 24 horas anteriores al final del periodo.
Prueba gratuita: si se ofrece, antes de empezarla se muestra su duración y el precio que se aplica después. Si no la cancelas al menos 24 horas antes de que termine, pasa a ser una suscripción de pago. La parte no usada de una prueba se pierde al comprar una suscripción.
Gestionar o cancelar en los ajustes de tu cuenta: en iPhone, Ajustes → tu nombre → Suscripciones; en Android, Google Play → Perfil → Pagos y suscripciones → Suscripciones. Desinstalar la App no cancela la suscripción.
Los reembolsos los gestionan Apple o Google según sus políticas, sin perjuicio de los derechos que te reconozca la normativa de consumo aplicable.
Si alguna vez cambiamos el precio de una suscripción existente, la tienda te avisará con antelación según sus normas.
8. Tu contenido
Las fotos y textos que envías siguen siendo tuyos. Nos das una licencia limitada y no exclusiva para tratarlos solo para prestar la App (incluido enviarlos a nuestro proveedor de IA), revisar denuncias y mejorar la App, como explica la Política de privacidad. No envíes contenido que no tengas derecho a usar.
9. Nuestra propiedad intelectual
La App, su diseño, textos, logotipo y software son nuestros o de nuestros licenciantes. Te concedemos una licencia personal, intransferible y revocable para usar la App en tus dispositivos con fines no comerciales, conforme a estos Términos y a las normas de la tienda.
10. Disponibilidad y cambios
Trabajamos para que la App esté disponible y sea precisa, pero no garantizamos que funcione sin interrupciones ni errores. Podemos actualizar, cambiar o retirar funciones. Si retiramos de forma significativa una función de pago, puedes cancelar tu suscripción en tu cuenta de la tienda.
11. Responsabilidad
La App se ofrece «tal cual». En la medida en que la ley lo permita, no respondemos de daños indirectos ni de decisiones tomadas a partir de respuestas de la IA, y nuestra responsabilidad total se limita a lo que hayas pagado por la App en los 12 meses anteriores a la reclamación. Nada de estos Términos limita la responsabilidad que la ley no permite limitar ni tus derechos legales como consumidor.
12. Cambios en estos Términos
Podemos actualizar estos Términos. Cambiaremos la fecha de arriba y, si el cambio es importante, te avisaremos en la App. Si sigues usando la App tras el cambio, aceptas los nuevos Términos.
13. Ley aplicable y conflictos
Estos Términos se rigen por la ley española. Si eres consumidor, conservas además la protección de las normas imperativas de tu país de residencia y puedes reclamar ante los tribunales de tu domicilio.
